Fiduciary Litigation

At Ikard Law PC, we represent trust beneficiaries, estate beneficiaries, settlors, trustees, executors, and limited partners in a myriad of fiduciary disputes.

We are involved in all types of trust-related litigation, including suits involving breach-of-fiduciary-duty claims against trustees, the removal of trustees, exculpatory and indemnity clauses, trust interpretation and modification, trust-accounting demands, and forcing trust distributions.  We represent beneficiaries, trustees, plaintiffs, and defendants; we also provide ongoing advice on trust administration and trust accounting.

In the estate context, we handle will contests (including disputes involving forfeiture and in terrorem clauses), breach-of-fiduciary-duty claims against executors and administrators, suits to remove executors and administrators, the interpretation of wills, demands for estate accountings, the distribution of estates.

We are also involved in guardianship litigation, including representing applicants seeking to become someone’s guardian, representing parties in contested guardianships, and representing guardians in their administration of ongoing guardianships.

Many fiduciary-related disputes involved claims against business entities such as limited partnerships, general partnerships, limited liability companies, corporations, and the people who manage these entities.  We represent our clients in these matters too.
